Luminal API — Terms of Service

1. These Terms
These Terms of Service (the “Terms”) are an agreement between you and Luminal AI, Inc. (“Luminal”, “we”, “us”). They cover the Luminal Text API at flash.luminal.cloud, the Luminal Images API at images.luminal.cloud, the dashboard at dash.luminal.com, and our documentation (together, the “Service”).
By creating an account, adding credit, or sending a request to the API, you accept these Terms. If you use the Service for a company or another organization, you confirm that you are authorized to accept these Terms on its behalf, and “you” means that organization. You must be at least 18 years old.
2. Your account and API keys
You sign in with the email address or identity provider you register on the dashboard. Keep your sign-in credentials and API keys secret. A key is shown once, when it is created; anyone who has it can spend your credit. You are responsible for every request made with your keys, including requests made by your own users or software.
You can revoke a key at any time on the dashboard or through the API. If you believe a key has been exposed, revoke it and tell us at the support address in section 14.
3. What the Service does
The Service provides text generation through an API compatible with the OpenAI chat-completions format, on the models named in our documentation, and image generation and editing through an API compatible with Ideogram’s, on the Ideogram 4.5 model. We answer text requests from servers we operate. When those servers are full, failing, or being updated, we send the request to a backup provider we contract with, so that it is still answered. We choose when; the price is the same either way. Image requests are answered by Ideogram, a third-party model provider we contract with. Providers apply their own usage policies to the requests they answer. We may decline, limit, or stop traffic that a provider requires us to. Our Privacy Policy, at dash.luminal.com/privacy, names the providers we currently use and what each says about the data it processes.
Model outputs, text and images alike, are generated by machine learning and can be wrong, incomplete, or biased. You are responsible for evaluating outputs before relying on them and for how you use them. Uses that can affect someone’s health, safety, legal position, or finances need human review that we do not provide.
The Service is new and changes often. We may add, change, or remove models, features, and limits. Where we reasonably can, we announce changes on the dashboard or by email before they take effect.
4. Prices, credit and payment
Text usage is priced per token and image usage per returned image, by quality tier, as published on the dashboard and in our documentation. Input tokens served from cache and the model’s reasoning tokens are priced as documented there. Prices may change; the current prices are the ones published on the dashboard.
The Service is prepaid, and one balance pays for both text and images. You add credit in US dollars by card through Stripe, between the minimum and maximum amounts shown on the billing page. Each completed text response is charged against your balance when it finishes. Each image request places a hold on your balance for the number of images requested at the applicable tier when it is submitted, and is charged for the images actually delivered when it completes; the rest of the hold is released. Images withheld under section 5 are not charged. Your balance and day-by-day usage are shown on the dashboard and through the API.
Credit is not refundable except where the law requires it, and it cannot be transferred to another account. Prices exclude taxes; you are responsible for any sales, use, VAT, or similar tax, which we may add to your payment where we are required to collect it.
We do not see or store your card details; Stripe processes payments under its own terms.
5. Acceptable use
You may not use the Service, or let anyone else use it through your account, to:
- break the law, or violate the rights of others, including intellectual-property and privacy rights;
- create or distribute sexual content involving minors, or any material, including generated images, that sexualizes, exploits, or endangers children;
- create or distribute intimate or sexual imagery of a real person without that person’s consent;
- create images that depict a real person in a deceptive way — a fabricated likeness, statement, or event presented as genuine — or otherwise use a person’s likeness without the right to do so;
- create content designed to defraud, including counterfeit documents, identification, currency, signatures, seals, or marks, or images meant to pass as authentic records or evidence;
- plan or promote violence or terrorism, or obtain meaningful help toward biological, chemical, nuclear, or radiological weapons;
- create malware, or attack, probe, or gain access to systems, accounts, or data without the owner’s permission;
- commit fraud, run phishing or scams, or impersonate a person or organization in order to deceive;
- harass, threaten, or dox people, or produce hate speech or content that incites violence or hatred against a person or group;
- generate spam or unsolicited bulk messages;
- send us personal data you have no right to share, such as another person’s health, financial, or government-identity information, without a lawful basis for doing so;
- circumvent rate limits or billing, share or resell API keys or access without our written consent, scrape the Service, or interfere with the Service or other customers’ use of it;
- reverse engineer, decompile, or copy the Service or its software, or use the Service to build, train, or benchmark a product or service that competes with it.
Image requests are also subject to the image provider’s usage policies (section 3). Images that the provider’s safety or copyright detection flags are withheld and not billed, and requests the provider refuses are refused by us with the provider’s reason. We may review flagged and refused requests under section 6.
6. Monitoring and enforcement
To keep the Service safe and to check compliance with section 5, we may monitor and review use of the Service, including by sampling API traffic and running it through automated safety tools, with a person reviewing what those tools flag. We keep what we review only as long as we need it for that purpose. Luminal does not use your requests or the model’s outputs to train models; a provider that answers a request may, as our Privacy Policy describes.
If we reasonably believe an account is being used in breach of section 5, or a payment has been reversed, or the law requires it, we may restrict or suspend the account. Where the law allows, we tell you the reason, and you can respond by writing to the support address in section 14.
7. Your content and your data
As between you and Luminal, your requests, and the outputs the model returns to you, are yours. You give us the permission we need to process them to provide the Service, to bill you, and to carry out section 6. To the extent the law allows, you own the outputs you receive; because models can produce the same output for different customers, we cannot promise that an output is unique to you.
Besides what section 6 describes, we keep per-request billing records (token and image counts, quality tier, timestamps, and request identifiers, not content) for as long as we need them for accounting, and operational logs for up to ninety days; those logs do not contain your requests or outputs but may include short excerpts of a provider’s error message. Our Privacy Policy describes this in more detail. A request answered by a third-party provider (section 3) is processed by that provider under its own terms. Your sign-in credentials and identity details are held by our sign-in provider, and your payment details by Stripe; we hold your account identifier, key records, balance and limits.
For image requests we also keep, for thirty days, an excerpt of the prompt of up to two kilobytes, the request’s settings and identifiers, and, where the provider refused the request, the reason it gave; and, for seven days, a copy of each delivered image, so that we can answer support questions and verify what you were billed for. Requests flagged by the provider’s safety or copyright detection may be reviewed by our staff under section 6. Luminal does not use your prompts, source images, or outputs to train models.
We protect your data with reasonable technical and organizational measures, but no service is perfectly secure. Tell us promptly at the support address if you become aware of unauthorized access to your account.
We collect technical data about how the Service is used, such as request and token counts, latency, and error rates. We own this data and may use it to operate, secure, and improve the Service, and may share it in aggregated or de-identified form that does not identify you.
8. Intellectual property
The Service, including its software, documentation, and branding, belongs to Luminal and its licensors. The models behind the Service, and their providers’ names and marks, belong to those providers. We give you a limited, non-exclusive, revocable right to use the Service under these Terms. If you send us suggestions or feedback, we may use them without obligation to you.
You are responsible for having the rights you need in the text and images you send us, including source and reference images, and for how you use the outputs. Where a provider’s terms grant or limit rights in outputs (section 3), those terms apply to the outputs it generates.
We may identify you as a customer, including by using your name and logo on our website and in our materials, unless you ask us in writing not to.
If you believe that content, including an image, generated by or available through the Service infringes your copyright, send a notice containing the information required by the Digital Millennium Copyright Act to the support address in section 14. We respond to valid notices and may close the accounts of repeat infringers.
9. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty that the Service will be uninterrupted or error-free or that outputs will be accurate or fit for any purpose.
10. Limitation of liability
To the fullest extent the law allows, Luminal is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from the Service or these Terms, however caused. Our total liability for all claims arising from the Service or these Terms is limited to the greater of the amount you paid us in the six months before the claim arose and one hundred US dollars. Some jurisdictions do not allow these limits; where that is the case they apply to the extent permitted.
11. Indemnity
You will defend and indemnify Luminal against claims, damages, and costs, including reasonable legal fees, that arise from your content, from your use of the Service in breach of section 5, or from your violation of the law or of someone else’s rights.
12. Ending the agreement
You can stop using the Service at any time by revoking your keys and closing your account. We may suspend or terminate your account immediately for a breach of section 5 or for non-payment, and otherwise with thirty days’ notice. Sections 7 through 14 survive termination.
13. Changes to these Terms
We may change these Terms at any time. The current version, with its effective date at the top, is always at dash.luminal.com/terms. Continuing to use the Service after a change means you accept the new Terms.
14. General
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and disputes will be brought in the state or federal courts located in California. You confirm that you are not subject to United States sanctions and will not use the Service in a country, or for a purpose, that United States export or sanctions law prohibits. These Terms, together with the prices and limits published on the dashboard, are the whole agreement between you and Luminal about the Service. If a part of these Terms is unenforceable, the rest remains in effect. You may not assign these Terms without our consent; we may assign them to a successor. Our not enforcing a provision is not a waiver of it.
Except for payment obligations, neither of us is responsible for a delay or failure caused by events beyond our reasonable control, including failures at our model or hosting providers, internet outages, natural disasters, war, labor disputes, or government action.
